Terms & Conditions of Service

1. Service Provider Identity & Scope of Contract

This agreement governs the terms and conditions under which Pablo Nasarre Codinach (hereinafter, the "Provider"), with registered address at Carrer dels Madrazo, 86, 08006 Barcelona, Spain, provides custom web design, technical deployment, and continuous managed maintenance services to businesses, brands, and professionals (hereinafter, the "Client").

Hiring or paying any fees implies full and unreserved acceptance of these contractual clauses.

2. Service Description & Technology Partners

The service is an all-in-one, turnkey digital solution designed so the Client enjoys an ultra-fast, secure, and legally compliant online presence without technical complexities:

  • Custom Coding & Design: Handcrafted website development in native code (HTML5, CSS3, JS) tailored to the establishment's offerings, menus, hours, and brand identity.
  • Managed Technical Hosting (Hostinger): The website is hosted on high-performance private cloud infrastructure supplied by Hostinger Operations, UAB, with servers within the European Union.
  • Secure Payments & Subscriptions (Stripe): All initial payments and recurring monthly fees are handled through Stripe Payments Europe, Ltd. under PCI-DSS Level 1 banking security standards.
  • Agile Support & Communication (WhatsApp): Updates, edits, and operational support are handled directly and conveniently via WhatsApp (Meta Platforms Ireland Ltd.).

3. Service Delivery Method & Domain Connection

Requirements gathering, proposal review, and DNS domain linking are conducted remotely (digitally) or in person as mutually agreed between the Client and Pablo Nasarre Codinach.

The domain name (e.g., restaurant.com) remains the exclusive property of the Client, who registers it under their own name. The Provider assists with full DNS configuration and validation.

4. Pricing, 3-Day Free Trial & Taxes (VAT Included)

Pursuant to Spanish and EU pricing transparency regulations:

  • 3-Day Free Trial Period: The Client enjoys an initial 3-day free trial upon initiating signup through Stripe to verify the website running live on the Hostinger managed server. During these 3 days, the Client may cancel with zero cost or penalty.
  • Managed Deployment & Maintenance: After the 3-day trial, the monthly managed fee is billed with VAT legally included, covering secure hosting, active SSL certificate, uptime monitoring, legal compliance, and continuous updates (photos, prices, menus, hours).
  • Official Invoicing: Pablo Nasarre Codinach acts as an individual developer providing bespoke software and web design services, issuing official tax-compliant invoices itemizing taxes according to the applicable tax regime.

5. Refund Policy & Legal Exception to Right of Withdrawal

Special Clause on Withdrawal & Refunds (Art. 103 TRLGDCU):

Article 103 of Spanish Royal Legislative Decree 1/2007 (Consumer Defense Law) establishes express statutory exceptions to the 14-day right of withdrawal:

  • Section c): The supply of goods or services made to the consumer's specifications or clearly personalized.
  • Section m): The supply of digital content or services whose execution has begun with the client's express consent and acknowledgment that they lose their right of withdrawal once completed.

Because the Provider provides a prior satisfaction guarantee (the Client tests and reviews the functional website live on mobile and desktop before paying), paying the €197 confirms full satisfaction. Consequently, once payment is made and the website is deployed, no refunds or returns are granted under any circumstance.

6. Cancellation of Recurring Maintenance & File Handover

The €20/month maintenance service (VAT included) requires no lock-in contract. The Client may cancel at any time following these simple steps:

Cancellation & Handover Procedure:

  1. 7-Day Prior Notice: The Client informs of their wish to cancel with at least 7 calendar days notice before the next billing date via email to contacto@pablonasarre.com or via Stripe Customer Portal.
  2. Full File Handover: Upon cancellation, Pablo Nasarre Codinach provides a secure download link containing a compressed archive (.ZIP) with all static files of the business website (clean HTML, CSS, JS, and provided images) so the Client can host it wherever they choose.
  3. Effects of Cancellation: At the conclusion of the billed monthly cycle, managed Hostinger hosting and ongoing support will terminate. The Provider bears no liability for installation or downtime on third-party servers.

7. Intellectual Property & File Ownership

Having paid the full development fee (€197), the Client holds exclusive, perpetual rights to use the website for their business, along with all provided brand assets and content. If maintenance is canceled, the Client retains full ownership of the handed-over files to deploy on any hosting provider.

8. Governing Law & Jurisdiction

This agreement shall be governed in all respects by Spanish law. For resolving any dispute arising from the interpretation or execution of this contract, both parties submit to the jurisdiction of the Courts of Barcelona (Spain).
